53-7-94. (Pre-1998 Probate Code) Revival of claims barred by statute of limitations; personal liability of administrator or executor for payment upon proof that claim was unjust


An administrator or executor, in his discretion, may relieve a debt from the bar interposed by the lapse of time by a new promise to pay, provided the bar had not occurred in the lifetime of the decedent. In such cases, the distributees may make the administrator or executor himself responsible for paying the debt by proving that the claim against the estate was in reality unjust.
