SECTION 11-41-25.1

   § 11-41-25.1  Theft of motor fuel. –Every person who shall leave the premises of a retail motor fuel dealer withoutpaying said dealer for fuel taken shall be guilty of larceny. Any personconvicted of violating this section, and the retail value of the fuel taken wasfive hundred dollars ($500) or less, shall be punished by imprisonment for notmore than one year or a fine of not more than five hundred dollars ($500) orboth. Any person convicted of violating this section, and the retail value ofthe fuel taken exceeds five hundred dollars ($500), shall be punished byimprisonment for not more than ten (10) years or by a fine of not more thanfive thousand dollars ($5,000) or both.
