SECTION 12-9-28

   § 12-9-28  Affidavits and documents tosupport application. – The application shall be verified by affidavit, shall be executed in duplicate,and shall be accompanied by two (2) certified copies of the indictmentreturned, or information and affidavit filed, or of the complaint made of thejudge, stating the offense with which the accused is charged, or of thejudgment of conviction, or of the sentence. The attorney general, the directorof corrections, or the warden may also attach any further affidavits and otherdocuments in duplicate that he or she shall deem proper to be submitted withthe application. One copy of the application, with the action of the governorindicated by endorsement on it, and one of the certified copies of theindictment, complaint, information, and affidavits, or of the judgment ofconviction, or of the sentence shall be filed in the office of the secretary ofstate to remain on record in that office. The other copies of all papers shallbe forwarded with the governor's requisition.
