SECTION 17-23-4

   § 17-23-4  Fraudulent or repeat voting.– Every person who, in any election, fraudulently votes or attempts to vote, notbeing qualified, notwithstanding that person's name may be on the voting listat the polling place where the person votes or attempts to vote; or who votesor attempts to vote in the name of some other person, whether that name is thatof a person living or dead, or of a fictitious person; or having voted in onetown, ward, senatorial district, representative district, or voting district,whether the person's vote in that case was legal or not, votes or attempts tovote in the same or in another town, ward, senatorial district, representativedistrict, or voting district; or who fraudulently votes or attempts to vote ina town, ward, senatorial district, representative district, or voting districtother than in the town, ward, senatorial district, representative district, orvoting district in which the person has his or her "residence", as defined in§ 17-1-3.1, at the time of his or her voting or attempting to vote; or whoaids, counsels, or procures any other person to so vote or attempt to vote,shall be guilty of a felony, and no person after conviction of this offense,shall be permitted to vote in any election or upon any proposition pendingbefore the people, or to hold any public office. Voting, for the purposes ofthis chapter, shall consist in the casting of a vote, or attempting to cast avote, whether or not the vote has been cast.
