SECTION 18-9.2-5

   § 18-9.2-5  Persons not subject toqualified dispositions. – Notwithstanding the provisions of § 18-9.2-4, this chapter shall not applyto defeat a claim brought by:

   (a) Any person to whom the transferor is indebted on orbefore the date of a qualified disposition on account of an agreement or orderof court for the payment of support or alimony in favor of the transferor'sspouse, former spouse or children, or for a division or distribution ofproperty in favor of the transferor's spouse or former spouse, but only to theextent of the debt; or

   (b) To any person who suffers death, personal injury, orproperty damage on or before the date of a qualified disposition by atransferor, which death, personal injury, or property damage is at any timedetermined to have been caused in whole or in part by the tortuous act oromission of either the transferor or by another person for whom the transferoris or was vicariously liable but only to the extent of such claim against suchtransferor or other person for whom such transferor is or was vicariouslyliable.
