SECTION 19-14-13

   § 19-14-13  Revocation of license. –(a) The director or the director's designee may, upon ten (10) days' notice tothe licensee, stating his or her intent to revoke and the grounds forrevocation, and upon reasonable opportunity for the licensee to be heard,revoke any license issued under this chapter, upon finding that:

   (1) The licensee has failed to comply with any demand,ruling, order, or requirement of the director or the director's designeelawfully made pursuant to and within the authority of this title;

   (2) The licensee has violated any provisions of this title or§ 6-26-2, or any rule or regulation lawfully made by the director or thedirector's designee under and within the authority of this chapter;

   (3) Any fact or condition exists which, if it had existed atthe time of the original application for the license, would have warranted thedirector or the director's designee in refusing originally to issue the license;

   (4) The licensee has committed any fraud, engaged in anydishonest activities, or made any misrepresentation;

   (5) The licensee has violated any provisions of this title orany regulation issued pursuant to this title;

   (6) The licensee has made a false statement in theapplication for the license or failed to give a true reply to a question in theapplication; or

   (7) The licensee has demonstrated incompetency oruntrustworthiness to act as a licensee pursuant to this chapter.

   (b) The burden of proving the existence of these facts orconditions as grounds for revocation of a license under this section shall beupon the director or the director's designee. The director or the director'sdesignee, if he or she has reasonable cause to believe that the grounds forrevocation exist, may subpoena and investigate the business, books, and recordsof the licensee.
