SECTION 21-28.2-15

   § 21-28.2-15  Chapter inapplicable incriminal cases. – The provisions of this chapter shall not be applicable with respect to anyperson against whom there is pending a criminal charge, whether by indictmentor by information, which has not been fully determined or who is on probationor whose sentence following conviction on that charge, including any time onparole or mandatory release, has not been fully served, except that:

   (1) This provision shall be applicable to any person onprobation, parole, or mandatory release if the authority authorized to requirethat person's return to custody consents to his or her commitment;

   (2) This provision shall be applicable to any person who isbefore a judge or justice on any criminal charge, only if the judge or justicefinds reasonable grounds to believe that the person is a narcotic addict. Ifthe judge or justice finds such reasonable grounds he or she shall inform thedirector of health of this finding and the director of health shall thenproceed in accordance with the provisions of this chapter.
