SECTION 23-15-6.1

   § 23-15-6.1  Action subsequent to review.– Development of any new institutional health services or new health careequipment approved by the state agency must be initiated within one year of thedate of the approval and may not exceed the maximum amount of capitalexpenditures specified in the decision of the state agency without priorauthorization of the state agency. The state agency, with the advice of thehealth services council, shall adopt procedures for the review of theapplicant's failure to develop new institutional health services or new healthcare equipment within the timeframe and capital limitation stipulated in thissection, and for the withdrawal of approval in the absence of a good faitheffort to meet the stipulated timeframe.
