§ 23-16.2-5 Establishment of rules andregulations – Hearing – Notice. – (a) The authority to promulgate regulations for the efficient enforcement ofthis chapter is vested in the director of health.

(b) Hearings authorized or required under this chapter shallbe conducted by the director of health or any officer, agent, or employee thatthe director of health may designate for this purpose.

(c) Before promulgating any regulation, the director ofhealth shall give appropriate public notice of its proposal and the time andplace for a public hearing on the proposed regulation. The regulation sopromulgated shall be filed with the office of the secretary of state and shallbecome effective on a date fixed by the director of health (which date shallnot be less than thirty (30) days after its promulgation). The regulation maybe amended or repealed in the same manner provided for its adoption.
