SECTION 23-16.3-13

   § 23-16.3-13  Hearing requirements –Procedure. – (a) The proceedings for the revocation, suspension or limiting of any licensemay be initiated by any person, corporation, association, or public officer orby the board by the filing of written charges with the board, but no licenseshall be revoked, suspended, or limited without a hearing before the boardwithin sixty (60) days after the filing of written charges in accordance withthe procedures established by the board. A license may be temporarily suspendedwithout a hearing for the period not to exceed thirty (30) days upon notice tothe licensee following a finding by the board that there exists a significantthreat to the public health and approved by the director.

   (b) Any appeal from the action of the board shall be inaccordance with the provisions of chapter 35 of title 42.
