SECTION 23-17.8-12

   § 23-17.8-12  Records of the department ofmental health, retardation, and hospitals. – In any administrative, civil, or criminal proceeding in which the status of thelicense of any facility which is licensed by the department of mental health,retardation, and hospitals is in issue, certified copies of relevant documentson file with the department and the certified statement of the director, his orher equivalent or his or her duly appointed designee as to the status of thelicense, shall be admissible as evidence of the status of the license, subjectto the right of the defendant to subpoena these records in rebuttal. Uponrequest, copies shall be provided to the person or his or her counsel at leastthree (3) days before the proceeding.
