SECTION 23-18.12-4

   § 23-18.12-4  Reporting –Determination of noncompliance – Orders – Appeals. – (a) The department shall report to the governor, the general assembly and thecorporation all findings of containers which are not in compliance with therequirements of this chapter, together with appropriate recommendations foradjustments in the containers.

   (b) Within one hundred (100) days of a written determinationthat any container does not comply with the provisions of this chapter, thecorporation may issue an order barring the container from use within the state.A person adversely affected or aggrieved by the issuance of an order under theprovisions of this section may seek judicial review of the order in thesuperior court.
