SECTION 23-18.9-11

   § 23-18.9-11  Prosecution of violations– Relief in equity or by prerogative writ. – (a) All prosecutions for the violation of any provision of this chapter, or anyrule or regulation made by the director in conformance with this chapter, shallbe by indictment or information. The director, without being required to enterinto any recognizance or to give surety for cost, or the attorney general ofhis or her own motion, may institute the proceedings in the name of the state.It shall be the duty of the attorney general to conduct the prosecution of allthe proceedings brought by the director.

   (b) The director may obtain relief in equity or byprerogative writ whenever relief shall be necessary for the proper performanceof his or her duties under this chapter. The superior court shall have thejurisdiction in equity to enforce the provisions of this chapter and any ruleor regulation made by the director under this chapter. Proceedings under thissection shall follow the course of equity and shall be instituted andprosecuted in the name of the director by the attorney general, but only uponthe request of the director.
