§ 23-18.9-9.2 Further requirements forlandfills. – In addition to any other requirements imposed by § 23-18.9-9, no licenseto operate a solid waste management facility which is a commercial landfillshall be issued and/or renewed by the director unless the applicant providesevidence of either: (1) bonding; and/or (2) a catastrophe fund, both to be inan amount and for a length of time as the director shall determine to benecessary to protect the general public's health and welfare from any potentialcomplication arising from the landfill. The director's determination as to theamount and length of time for the bond and/or catastrophe fund shall be final.The applicant's evidence of the bonding and/or catastrophe fund shall beavailable for public inspection at the department.
