§ 23-19.12-15 Civil or administrativepenalties. – (a) Failure to comply with the provisions of this chapter or the rules,regulations, standards and procedures promulgated under the authority of thischapter shall be punishable by a civil or administrative penalty for an amountnot to exceed five thousand dollars ($5,000). In the event of a continuingviolation of the provisions of this chapter or the rules, regulations,procedures, or standards promulgated under the provisions of this chapter, eachand every day of violation shall constitute a separate and distinct violation.Administrative penalties shall be assessed in conformance with and under theprovisions of the administrative penalties for environmental violations §42-17.6 et seq. Civil penalties may be sought in any court of competentjurisdiction.
(b) Willful failure to comply with the provisions of thischapter or the rules, regulations, standards, and procedures promulgated underthe authority of this chapter shall be punishable by a civil or administrativepenalty for an amount not to exceed twenty-five thousand dollars ($25,000). Inthe event of a continuing violation of the provisions of this chapter or therules, regulations, procedures, or standards promulgated under the provisionsof this chapter, each and every day of violation shall constitute a separateand distinct violation. Administrative penalties shall be assessed inconformance with and under the provisions of the administrative penalties forenvironmental violations § 42-17.6 et seq. Civil penalties may be soughtin any court of competent jurisdiction.
