SECTION 23-19-11.3

   § 23-19-11.3  Central landfill – Waterquality and public health. – (a) The corporation shall be committed to completion of appropriate studies ofthe ground and surface water under and adjacent to the central landfill todetermine whether and to what extent contamination from the central landfillmay affect water quality or public health, and to what extent any contaminationhas a significant impact on human health or the environment. This requirementmay be satisfied in part or in full by studies already underway and incompliance with the Comprehensive Environmental Response, Compensation andLiability Act of 1980, 42 U.S.C., § 9601 et seq. ("CERCLA") or otherapplicable federal or state environmental statutes.

   (b) If the studies determine that there is in fact an impactby the landfill on water quality or public health, which is not remediated bythe installation of public water, then the corporation shall be responsible totake additional remedial action required to further protect public health or topreserve important environmental qualities which are determined to bethreatened. As in the case of studies, this requirement may be satisfied inwhole or in part by remedial actions required under CERCLA or other applicablefederal or state environmental statutes.
