SECTION 23-22.5-11

§ 23-22.5-11 City and town responsibilityfor bathing areas. – All cities and towns that own or maintain public beaches and swimming areasshall be fully responsible for the upkeep and maintenance of that beach orswimming area, and for the upkeep and maintenance of all toilet facilities atthese areas, and are required to furnish qualified personnel to serve aslifeguards during the swimming season. The department of environmentalmanagement shall have jurisdiction to enforce the provisions of this sectionand to order those cities and towns to comply with any department directiveregarding those facilities.
