SECTION 23-22-7

   § 23-22-7  Issuance or denial of license.– Upon the application for a license to maintain a swimming pool, the departmentof health shall, within thirty (30) days from the time that the application ismade, grant the application and issue a license to maintain a swimming pool ifthe department shall be satisfied that its rules and regulations relating tothe condition, maintenance, and water of a swimming pool are complied with bythe applicant, and the condition and method of maintaining the swimming poolwill not be detrimental to the health and safety of its users, otherwise thedepartment shall decline to issue a license until it is satisfied with thecondition, maintenance, and water of the swimming pool. In case the departmentshall decline to issue a license, it shall, upon the written request of theapplicant, make a further inspection of the swimming pool maintained by theapplicant and upon the applicant's written request shall also make a furtheranalysis of the water of the swimming pool. If after further inspection andfurther analysis the department shall determine that the applicant is still notentitled to a license, it shall, before finally refusing to issue the license,give the applicant an opportunity to be heard in support of the application.
