SECTION 23-24.4-4

   § 23-24.4-4  Community access. – (a) Any resident of the state shall have the right to make a reasonable requestfrom the department for copies of lists of designated substances and materialsafety data sheets as defined in this chapter. These requests may be made inperson during normal business hours or by mail.

   (b) The department shall obtain the requested material asprovided for in § 23-24.4-5 and provide the resident making the requestwith the information within five (5) working days of obtaining the informationfrom the employer; provided, however, that the director of labor and trainingshall have the right to refuse unreasonable requests.

   (c) The department is empowered to impose a fee on theresident for each employer request, not to exceed ten dollars ($10.00) peremployer request together with the submitted employer's cost of photocopyingthe duplicate lists requested. Photocopying costs collected shall be reimbursedto the employer.

   (d) The compliance with any subsequent request of aparticular employer shall be the responsibility of the department.
