SECTION 23-24-5

   § 23-24-5  Penalties. – (a) Any person who violates any of the provisions of § 23-24-4 shall beguilty of a misdemeanor and shall on conviction be subject to a fine of notmore than five hundred dollars ($500) or to imprisonment for not more thanninety (90) days, or both; but for offenses committed with intent to defraud ormislead, or for second and subsequent offenses, the penalty shall beimprisonment for not more than one year, or a fine of not more than threethousand dollars ($3,000), or both.

   (b) No person shall be subject to the penalties of subsection(a) of this section:

   (1) For having violated § 23-24-4(3) if the receipt,delivery, or proffered delivery of the hazardous substance was made in goodfaith, unless he or she refuses to furnish on request of an officer or employeeduly designated by the consumer protection unit, the name and address of theperson from whom he or she purchased or received the hazardous substance, andcopies of all documents, if there are any, pertaining to the delivery of thehazardous substance to him or her; or

   (2) For having violated § 23-24-4(2) if he or sheestablishes a guarantee or undertaking, signed by and containing the name andaddress of the person residing in the state of Rhode Island from whom he or shereceived in good faith the hazardous substance, to the effect that thehazardous substance is not a misbranded hazardous substance or a bannedhazardous substance within the meaning of those terms in this chapter.
