§ 23-28.28-34 Penalty for violations– Seizure of explosives. – (a) Any person who violates any provision of this chapter shall, uponconviction, be imprisoned for a term of not more than one year, or shall befined not more than one thousand dollars ($1,000) or both.

(b) The state fire marshal or his or her deputies or anyofficer qualified to serve criminal process may arrest without a warrant anyperson found in violation of this chapter and shall seize immediately any andall explosives in illegal possession, use, or under his or her control, and theexplosives seized shall upon conviction of that person be forfeited to thestate.

(c) Notice of seizure of the explosives under subsection (b)shall immediately be sent to the state fire marshal by the officer making theseizure and the explosives seized shall be turned over to the state firemarshal to be held pending the trial.
