SECTION 23-34.1-13

   § 23-34.1-13  Insurance. – A person may not operate an amusement device or amusement attraction unless atthe time of operation there is in existence:

   (1) An insurance policy in an amount of not less than onemillion dollars ($1,000,000) per occurrence insuring the owner or lesseeagainst liability for injury to persons arising out of the use of the amusementdevice or amusement attraction; or

   (2) A bond in a like amount; however, the aggregate liabilityof the surety under such bond shall not exceed the face amount thereof.

   The policy or bond shall be procured from one or moreinsurers or sureties licensed to transact business in this state or approved assurplus lines insurers. Proof of insurance or bond must be presented to thedepartment in order to obtain a permit.
