SECTION 23-39-7

   § 23-39-7  Licensing by training andexamination. – (a) Any person desiring to become licensed as a respiratory care practitionershall make application to the board on a written form in the manner that theboard prescribes, pay all required application fees, and certify and furnishevidence to the board that the applicant:

   (1) Has successfully completed a training program as definedin this chapter;

   (2) Has passed the examination approved by the board, asspecified by rules and regulations of the department, for respiratory carepractitioners administered by a nationally recognized organization forrespiratory care; and

   (3) Is of good moral character.

   (b) Respiratory care providers who are licensed or otherwiseregulated to practice under laws of another state or territory or the Districtof Columbia may, upon receiving an authorization from the division, perform asa respiratory care practitioner under the supervision of a qualified andlicensed respiratory care practitioner. If the applicant fails to receivelicensure when the board reviews the application, all mentioned privilegesshall automatically cease.
