SECTION 27-14.3-59

   § 27-14.3-59  Claims of nonresidentsagainst insurers domiciled in this state. – (a) In a liquidation proceeding begun in this state against an insurerdomiciled in this state, claimants residing in foreign countries or in statesnot reciprocal states must file claims in this state, and claimants residing inreciprocal states may file claims either with the ancillary receivers, if any,in their respective states, provided a claim filing procedure is established inthe ancillary proceeding, or with the domiciliary liquidator. Claims must befiled on or before the last date fixed for the filing of claims in thedomiciliary liquidation proceeding.

   (b) Claims belonging to claimants residing in reciprocalstates may be proved either in the liquidation proceeding in this state asprovided in this chapter, or in ancillary proceedings, if any, in thereciprocal states, provided a claim filing procedure is established in theancillary proceeding. If notice of the claims and opportunity to appear and beheard is afforded the domiciliary liquidator of this state as provided in§ 27-14.3-60(b) with respect to ancillary proceedings, the final allowanceof claims by the courts in ancillary proceedings in reciprocal states shall beconclusive as to amount and as to priority against special deposits or othersecurity located in the ancillary states, but shall not be conclusive withrespect to priorities against general assets under § 27-14.3-46.
