SECTION 27-34-3

   § 27-34-3  Scope. – This chapter shall apply to all kinds of direct insurance, but shall not beapplicable to the following:

   (1) Life, annuity, health, or disability insurance;

   (2) Mortgage guaranty, financial guaranty or other forms ofinsurance offering protection against investment risks;

   (3) Fidelity or surety bonds, or any other bondingobligations;

   (4) Credit insurance;

   (5) Insurance of warranties or service contracts;

   (6) Title insurance;

   (7) Ocean marine insurance, except that portion of the marineprotection and indemnity insurance covering liability of the insured forpersonal injury, illness, or death to employees and insurance covering pleasurecraft;

   (8) Commercial lines excess liability insurance;

   (9) Any transaction or combination of transactions between aperson, including affiliates of the person, and an insurer, includingaffiliates of the insurer, which involves the transfer of investment or creditrisk unaccompanied by transfer of insurance risk; and

   (10) Any transaction or combination of transactions between aprotected cell and the general account or another protected cell of a protectedcell company organized under the Protected Cell Companies Act, chapter 64 ofthis title, as those terms are defined in this chapter.
