SECTION 27-9.1-5

   § 27-9.1-5  Response and statement ofcharges. – The director shall provide an initial response within two (2) weeks to anywritten consumer complaint containing specific and credible allegation of anunfair claims settlement practice punishable pursuant to this chapter. Wheneverthe director has reasonable cause to believe that any insurer doing business inthis state is engaging in any unfair claims practice and that a proceeding inrespect to the practice would be in the public interest, the director shallissue and serve upon the insurer a statement of the charges in that respect anda notice of hearing, which notice shall set a hearing date not less than thirty(30) days from the date of the notice.
