SECTION 28-2-3

   § 28-2-3  Inability to find work asdefense. – In no case shall the claim by the accused of his inability to obtain work oremployment be a defense to a prosecution under this chapter, unless it isproven that the accused promptly notified the director of labor and training ofhis inability to obtain employment, requested that work or employment be foundfor him, that the employment was not furnished, and he holds a certificate fromthe director of labor and training, or his or her duly authorized subordinate,that the application has been made.
