SECTION 28-25-10

   § 28-25-10  Inspection and certification ofboilers – Permit to install – Notice, report, and standards foralterations and repairs – Minimum standard. – (a) No boiler or pressure vessel shall be erected within this state unless itis constructed and equipped with safety devices in compliance with thestandards and rules set forth in the ASME Boiler and Pressure Vessel Code. Anyperson erecting or installing any boiler or pressure vessel shall notify thedivision to that effect. Upon that notice, the administrator shall then satisfyhimself or herself, by inspection or other evidence satisfactory to him or her,that the boiler complies with the requirements of this chapter. Upon beingsatisfied, the administrator, upon payments by that person of a fee set by thecode commission of occupational safety & health, shall issue a certificate.

   (b) Any person erecting or installing a new or second-handboiler or pressure vessel shall first make application for a permit to installto the division of occupational safety, boiler unit, at a fee established bythe code commission. The administrator shall then satisfy himself or herselfeither by inspection or by other evidence satisfactory to him or her that theboiler or pressure vessel complies with the requirements of this chapter, andupon being satisfied, the administrator shall upon payment of the required feefurnish to the owner of the boiler or pressure vessel a certificate to thateffect.

   (c) It shall be mandatory that the organization performingthe repair/alteration notify the division of occupational safety, boiler unitor an authorized inspector before initiating any alterations or welded repairsto any boiler or pressure vessel within the state. Upon completion of thealteration or welded repair, a properly executed alteration or welded repairform as outlined in the NBIC shall be filed with the division.

   (d) The state adopts the ASME Boiler and Pressure Vessel Codefor new construction and the National Board Inspection Code for repairs andalterations to boilers and pressure vessels. It is mandatory that all repaircontractors hold the appropriate ASME certificate of authorization or a validNational Board "R" (repair) or "VR" (safety valve repair) symbol stamp issuedby the National Board of Boiler and Pressure Vessel Inspectors, as applicable.

   (e) Antique boilers or unfired pressure vessels used inpublic, non-profit, engineering, and/or scientific museums operated foreducational, historical, or exhibition purposes shall be approved prior tooperation in this state on an individual basis. Approval for operation will begiven only after satisfactory review of drawings and calculations, applicationof a hydrostatic test at a pressure deemed necessary by the jurisdictionalauthority, and the boiler or pressure vessel is equipped with all the approvedsafety devices as required by the rules and regulations promulgated by theboard.
