SECTION 28-29-3

   § 28-29-3  Defenses abrogated as toinjuries in course of employment. – In an action to recover damages for personal injury sustained by an employeearising out of and in the course of his or her employment, connected with andreferable to the employment, or for death resulting from personal injury sosustained, it shall not be a defense:

   (1) That the employee was negligent;

   (2) That the injury was caused by the negligence of a fellowemployee;

   (3) That the employee has assumed the risk of the injury.
