SECTION 28-34-9

   § 28-34-9  Notice to employer of claim.– The employer to whom notice of death or disability is to be given, or againstwhom claim is to be made by the employee, shall be the employer who lastemployed the employee during the thirty-six (36) months in the employment tothe nature of which the disease was due, and that notice and claim shall bedeemed seasonable as against prior employers. The requirements as to notice asto occupational disease and death resulting from it and the requirements as tothe bringing of proceedings for compensation for disability or death resultingfrom the occupational disease shall be the same as required in chapter 33 ofthis title, except that the notice shall be given to the employer within ninety(90) days after disablement.
