SECTION 28-40-12

   § 28-40-12  Civil action to recovercontributions. – If any employer fails to make any payment of contributions or interest on themat the time and in the manner required by the prescribed rules and regulations,the amount of contributions so due shall be collected by civil action. Allcivil actions shall be instituted in the name of the director, and he or sheshall be exempt from giving any surety for costs. Civil actions brought underthis section, to collect contributions or interest on them, shall be heard bythe court having jurisdiction at the earliest possible date, and shall beentitled to preference upon the calendar of the court over all other civilactions except petitions for a judicial review under chapters 39 – 41 ofthis title.
