SECTION 28-42-12

   § 28-42-12  Election by exempt employer tobecome subject to provisions. – Any employing unit for which services are performed that do not constituteemployment as defined in this chapter, may file a written election with thedirector that all services performed by individuals in its employ in one ormore distinct establishments or places of business, shall be deemed toconstitute employment for all the purposes of chapters 42 – 44 of thistitle for not less than two (2) calendar years. Upon the written approval ofthat election by the director, those services shall be deemed to constituteemployment subject to those chapters from the date stated in the approval.Those services shall cease to be deemed employment subject to these chapters asof January 1 of any calendar year subsequent to those two (2) calendar years,only if not later than January 31 of that calendar year, either that employingunit has filed with the director a written notice to that effect, or thedirector on his or her own motion has given notice of termination of thatcoverage.
