SECTION 30-13-69

   § 30-13-69  Error of law – Lesserincluded offense. – (a) A finding or sentence of a court-martial may not be held incorrect on theground of an error of law unless the error materially prejudices thesubstantial rights of the accused.

   (b) Any reviewing authority with the power to approve oraffirm a finding of guilty may approve or affirm so much of the finding asincludes a lesser included offense.
