SECTION 30-13-70

   § 30-13-70  Review counsel. – (a) Upon the final review of a sentence of a general court-martial or of asentence to a bad-conduct discharge, the accused has the right to berepresented by counsel before the reviewing authority, before the staff judgeadvocate or legal officer, as the case may be, and before the state judgeadvocate.

   (b) Upon the request of an accused entitled to be sorepresented, the state judge advocate shall appoint a lawyer who is a member ofthe state military forces and who has the qualifications prescribed in §30-13-29, if available, to represent the accused before the reviewingauthority, before the staff judge advocate or legal officer, as the case maybe, and before the state judge advocate, in the review of cases specified insubsection (a) of this section.

   (c) If provided by him or her, an accused entitled to be sorepresented may be represented by civilian counsel before the reviewingauthority, before the staff judge advocate or legal officer, as the case maybe, and before the state judge advocate.
