SECTION 30-15.9-4

   § 30-15.9-4  Limitations. – Any party state requested to render mutual aid or conduct exercises andtraining for mutual aid shall take such action as is necessary to provide andmake available the resources covered by this compact in accordance with theterms hereof: provided, that it is understood that the state rendering aid maywithhold resources to the extent necessary to provide reasonable protection forsuch state.

   Each party state shall afford to the emergency forces of anyparty state, while operating within it state limits under the terms andconditions of this compact, the same powers (except that of arrest unlessspecifically authorized by the receiving state), duties, rights, and privilegesas are afforded forces of the state in which they are performing emergencyservices. Emergency forces will continue under the command and control of theirregular leaders, but the organizational units will come under the operationalcontrol of the emergency services authorities of the state receivingassistance. These conditions may be activated, as needed, only subsequent to adeclaration of a state of emergency or disaster by the governor of the partystate that is to receive assistance or commencement of exercises or trainingfor mutual aid and shall continue so long as the exercises or training formutual aid are in progress, the state of emergency or disaster remains ineffect or loaned resources remain in the receiving state(s) whichever is longer.
