SECTION 31-3.2-10

   § 31-3.2-10  Penalties. – Any person who violates any provisions of this chapter or any regulation of thedirector of the department of environmental management or the administrator ofthe division of motor vehicles shall be guilty of a misdemeanor for a firstoffense and be punished by a fine of not more than one hundred dollars ($100)or by imprisonment for not more than ninety (90) days, or both, and shall berequired to take or retake a safety education certificate course that has beenapproved by the director; for a second offense, be punished by a fine of notmore than two hundred fifty dollars ($250) or by imprisonment for not more thanninety (90) days, or both; and for a third or subsequent offense, be punishedby a fine of not more than five hundred dollars ($500) or by imprisonment fornot more than ninety (90) days, or both. The director may suspend or revoke theregistration of a snow vehicle or a recreational vehicle, after a hearing, forgood cause which shall include, but not be limited to:

   (1) Nonownership by the applicant;

   (2) The failure of the vehicle to meet equipment standardsafter the owner has received notice to comply with the standards;

   (3) Operation of the vehicle improperly or in such a manneras to cause damage to any property or death or injury to any person, or thatthe registrant has allowed or permitted the vehicle to be so operated.

   (4) Repeat violations of this chapter or any associatedregulation.
