SECTION 31-31-16

   § 31-31-16  Drivers not licensed in state– Unregistered vehicles – Out of state accidents. – (a) In case the driver or the owner of a vehicle of a type subject toregistration under the laws of this state involved in an accident within thisstate has no license or registration in this state, then the driver shall notbe allowed a license, nor shall the owner be allowed to register any vehicle inthis state, until the owner has complied with the requirements of this chapterto the same extent that would be necessary if, at the time of the accident, heor she had held a license or been the owner of a vehicle registered in thisstate.

   (b) When a nonresident's operating privilege is suspendedpursuant to § 31-31-9, the division of motor vehicles shall transmit acertified copy of the record of the action to the official in charge of theissuance of licenses and registration certificates in the state in which thenonresident resides, if the law of the other state provides for action similarto that provided for in subsection (c) of this section.

   (c) Upon receipt of certification that the operatingprivilege of a resident of this state has been suspended or revoked in anyother state pursuant to a law providing for its suspension or revocation forfailure to deposit security for the payment of judgments arising out of a motorvehicle accident, under circumstances which would require the division of motorvehicles to suspend a nonresident's operating privilege had the accidentoccurred in this state, the division of motor vehicles shall suspend thelicense of the resident if he or she was the driver, and all of the resident'sregistrations if he or she was the owner of a motor vehicle involved in theaccident. The suspension shall continue until the resident furnishes evidenceof his or her compliance with the law of the other state relating to thedeposit of the security.
