SECTION 32-2-4

   § 32-2-4  Rules and regulations –Enforcement – Powers of director. – (a) The director of the department of environmental management may make rulesand regulations for the control, government, and use of all the publicproperties and highways under his or her care. A person violating the rules andregulations promulgated pursuant to this section shall be guilty of a civilviolation and be subject to a fine not to exceed one hundred dollars ($100) foreach offense. Jurisdiction over violations of this section shall be with thetraffic tribunal. In accordance with chapter 42-17.10, any person charged withviolating the rules and regulations promulgated pursuant to this section mayelect to dispose of the charge without personally appearing before the traffictribunal by mailing or delivering the form and summons to the traffic tribunalwith a check or money order in the amount of one hundred dollars ($100). Ingeneral, the director may do all acts needful for the proper execution of thepowers and duties granted to and imposed upon the director by the terms of thischapter. The director shall also have power to expend such funds as may begiven in trust, and the income thereof, in accordance with the terms of thetrusts, as provided for in § 32-2-6.

   (b) Those persons duly authorized by the director of thedepartment of environmental management to exercise the powers specified in§§ 2-10-13, 2-12-8, 2-12-19, 37-15-2, and/or 46-22-17, may also becommissioned by the director of the department to enforce any rules orregulations promulgated by the director of the department as applicable topublic properties under his or her care.
