SECTION 33-1.1-10

   § 33-1.1-10  Exercise of power ofappointment. – (a) As to any exercise of a power of appointment in favor of the slayer in thewill of the decedent, the slayer shall be deemed to have predeceased thedecedent and the appointment to have lapsed.

   (b) Property held either presently or in remainder by theslayer subject to be divested by the exercise by the decedent of a power ofrevocation or a general power of appointment shall pass to the estate of thedecedent; and property so held by the slayer subject to be divested by theexercise by the decedent of a power of appointment to a particular person orpersons, or to a class of persons, shall pass to such person or persons, orclass of persons in equal shares to the members of such class of persons,exclusive of the slayer.
