SECTION 33-23-11

   § 33-23-11  Failure to file appeal claimed.– If the appellant fails to file his or her reasons of appeal in the superiorcourt within the time allowed by § 33-23-1(a)(2), the probate court fromwhich the appeal was taken shall, upon petition of any person interested, andupon such notice to the appellant as the court shall order, affirm the order ordecree appealed from and further proceed as if no claim of appeal had beenfiled; and in that case the probate court may award double costs against theappellant.
