SECTION 33-5-1

   § 33-5-1  Definitions. – As used in this chapter and chapter 6 of this title:

   (1) "Personal estate" shall extend to leasehold estate, andother chattels real, and also to money, stocks and other funds, securities formoney, debts, choses in action, rights, credits, goods, and all other propertywhatsoever which by law devolve upon the executor or administrator and to anyshare or interest therein;

   (2) "Real estate" shall extend to lands, tenements andhereditaments, whether freehold or of any other tenure, and whether corporealor incorporeal, and to any undivided share, of real estate, and to any estate,right or interest other than a chattel interest therein; and

   (3) "Will" shall extend to a testament and to a codicil andto an appointment by will, or by writing in the nature of a will, in exerciseof a power.
