§ 33-9-24 Continuation of actions by oragainst decedent. – In case any action, suit, or proceeding is commenced or shall be pending in anycourt, and either party shall die before final judgment, the executor oradministrator of the deceased person, or his or her successor in case thedeceased was acting in a representative capacity, may, if the cause of actionsurvives, prosecute or defend the action, suit, or proceeding to final judgment.
