SECTION 34-37-4.2

   § 34-37-4.2  Exemptions – Religiousorganizations and private clubs. – (a) Nothing in this chapter shall prohibit a religious organization,association, or society or any nonprofit institution or organization operated,supervised, or controlled by or in conjunction with a religious organization,association, or society from limiting the sale, rental, or occupancy of adwelling which it owns or operates for other than commercial purposes topersons of the same religion or from giving preference to those persons unlessmembership in the religion is restricted on account of sex, sexual orientation,gender identity or expression, race, color, or national origin or disability.Nor shall anything in this chapter prohibit a private club not in fact open tothe public which as an incident to its primary purpose or purposes provideslodgings which it owns or operates for other than a commercial purpose fromlimiting the rental or occupancy of the lodgings to its members or from givingpreference to its members.

   (b) Nothing in this chapter limits the applicability of anyreasonable local, state, or federal restrictions regarding the maximum numberof occupants permitted to occupy a dwelling.
