SECTION 34-40-1

   § 34-40-1  Definitions. – For the purposes of this chapter:

   (1) "Solar easement" means a right, whether or not stated inthe form of restriction, easement, covenant, or conditions in any deed, will,or other instrument executed by or on behalf of any owner of land or solarskyspace for the purpose of ensuring adequate exposure of a solar energy systemas defined in § 44-39-1(b)(1).

   (2) "Solar skyspace" means the space between a solar energysystem and the sun which must remain unobstructed such that on any given clearday of the year, not more than ten percent (10%) of the collectible insolationshall be blocked.
