SECTION 34-44-4.1

   § 34-44-4.1  Court determinations required.– Prior to ordering any work or the furnishing of any materials to abate a publicnuisance under this chapter, the court shall review the submitted financial andconstruction plan and shall make all of the following findings:

   (1) The estimated cost of the labor, materials, and any otherdevelopment costs required to abate the public nuisance;

   (2) The estimated income and expenses of the property afterthe furnishing of the materials and the completion of the repairs andimprovements;

   (3) The need for conditions and availability of any financingthat is necessary for the performance of the work and the furnishing of thematerials;

   (4) If repair and rehabilitation of the building are notfound to be feasible, the cost of demolition of the building, or the portionsof the building that constitute the public nuisance.
