SECTION 36-10-1

   § 36-10-1  Member contributions –Deduction from compensation. – (a) Each member of the retirement system shall contribute an amount equal toeight and one-half percent (8.5%) of his or her compensation as his or hershare of the cost of annuities, benefits, and allowances; provided, however,that each member will also initially contribute one eighth of one percent(0.125%) in the fiscal year beginning July 1, 1989, and one eighth of onepercent (0.125%) in the fiscal year beginning July 1, 1990. Any contributionsmade by employees prior to July 1, 1990, for the purpose of providing healthbenefits to retirees as provided in § 36-12-4 shall be transferred to eachemployee's retirement annuity account. Every person being a member of thegeneral assembly and electing to participate in the benefits provided bychapters 8 – 10 of this title, in accordance with the provisions of §36-9-6, shall contribute an amount equal to thirty percent (30%) of his or hercompensation. The contributions shall be made in the form of deductions fromcompensation.

   (b) The deductions provided for herein shall be madenotwithstanding that the minimum compensation provided by law for any membershall be reduced thereby. Every member shall be deemed to consent and agree tothe deductions made and provided for herein and shall receipt for his or herfull compensation and payment of compensation, less the deductions, shall be afull and complete discharge and acquittance of all claims and demandswhatsoever for the services rendered by the person during the period covered bythe payment except as to the benefit provided under this chapter.
