SECTION 37-16-7

   § 37-16-7  Method of appointing arbitratorsor umpire. – If in the contract providing for arbitration, provision is made for a method ofnaming or appointing an arbitrator or arbitrators or an umpire, that methodshall be followed, but if no method be provided therein, then the parties tothe contract shall agree to the method of naming or appointing an arbitrator orarbitrators or an umpire and if the parties shall fail to agree, then the courtor the judge thereof upon application of either of the parties after due noticeto the other party shall appoint an arbitrator to hear the dispute.
