SECTION 37-2-43

   § 37-2-43  Contract clauses and theiradministration. – (a) The chief purchasing officer is authorized to issue regulations permittingor requiring the insertion, in contracts for the procurement of supplies orservices, of appropriate clauses to enable the chief purchasing officer toeffect desired changes and modifications to those contracts.

   (b) The chief purchasing officer shall issue regulationsrelating to the termination of contracts for the procurement of supplies orservices in the event of (1) default of the contractor, or (2) uponnotification to said chief purchasing officer by the director of the departmentof environmental management that there has been a final adjudication or otherresolution, as a result of which a fine of five thousand dollars ($5,000) ormore has been imposed, that a contractor has violated any state law orregulation pertaining to the protection of fresh water wetlands (chapter 1 oftitle 2), coastal wetlands, (chapter 23 of title 46), air quality (chapter 23of title 23), water quality (chapter 12 of title 46), the installation ofindividual sewage disposal systems (chapter 17.1 of title 42), the handlingand/or disposal of solid waste (chapter 19 of title 23) or hazardous waste(chapter 19.1 of title 23), whether or not such violation has any relation tothe contract to be terminated.

   (c) The chief purchasing officer shall issue regulationsrelating to the termination of contracts for the procurement of supplies orservices for the convenience of the contractor, and/or the state.
