SECTION 37-2-69

   § 37-2-69  Provision of architectural,engineering, or consultant services not exceeding twenty thousand dollars.– (a) State agencies. (1) For every state project requiring architecturalor engineering services, the fees for which are not reasonably expected toexceed twenty thousand dollars ($20,000), the state agency shall forward to thechief purchasing officer a request for those services through the statepurchasing office.

   (2) For every state agency project requiring consultantservices, the fees for which are not reasonably expected to exceed twentythousand dollars ($20,000), the state agency shall forward to the chiefpurchasing officer a request for such services through the state purchasingoffice with a proposed scope of work and, if possible, the names of threerecommended qualified contractors, along with a written evaluation of thequalifications of each potential contractor.

   (3) The purchasing agent shall request offers from potentialcontractors in writing and shall notify potential contractors that any contractresulting from such solicitation shall not exceed a total value of twentythousand dollars ($20,000), including change orders.

   (4) The chief purchasing officer shall be responsible for thefinal selection of a qualified architectural, engineering, or consultant firmfor the project and shall so inform the purchasing agent. The chief purchasingofficer shall use the criteria set forth in § 37-2-61 in making thatdetermination. The determination shall be justified in writing.

   (b) Public agencies. For every public agency projectrequiring architectural, engineering, or consultant services, the fees forwhich are not reasonably expected to exceed twenty thousand dollars ($20,000),the public agency chief operating officer shall be responsible for the finalselection of a qualified architectural, engineering, or consultant firm for theproject. The public agency chief operating officer shall notify the board ofdirectors of the public agency of that selection.

   The public agency chief operating officer shall use thecriteria set forth in § 37-2-66 in making the determination. Thatdetermination shall be justified in writing.
