SECTION 37-7.1-5

   § 37-7.1-5  Transfer of Smithfieldproperty. – The director of the Rhode Island Department of Transportation, upon writtenrequest of the executive director of the Rhode Island Economic DevelopmentCorporation, is hereby authorized and directed to grant, transfer, and conveyin fee simple or otherwise, as set forth in such request, in the name of andfor the state of Rhode Island to the Rhode Island Economic DevelopmentCorporation that certain real estate described below and all improvementsthereon belonging to the state of Rhode Island situated in the town ofSmithfield, Rhode Island, or portions thereof as determined by the executivedirector of the Rhode Island Economic Development Corporation. The provisionsof §§ 37-6-1 et seq. and 37-7-1 et seq. shall not be applicable tothe conveyance or conveyances set forth herein which have been or hereafter maybe effected by the Rhode Island Economic Development Corporation under theprovisions of this chapter.

   (a) Parcel 1: That certain tract or parcel of land situatedin the town of Smithfield, county of Providence, state of Rhode Island, andbounded and described as follows:

   Beginning at the southeast corner of said parcel at a pointfifty (50) feet southwesterly of, and opposite state 301+75.00 as shown onState Highway Plat #365;

   Thence running northeasterly, bounded southwesterly by landnow or formerly of Richard Conti and by land now or formerly of Joseph andIrene Bruno, for a distance of seven hundred sixty-three and ninety-hundredths(763.98) feet to a point, said point being one hundred (100) feet southeasterlyof and opposite station 207+00 as shown on State Highway Plat #361;

   Thence turning an interior angle of 90d-00'-00" and runningnortheasterly, bounded northwesterly by Route 116, for a distance of fourhundred forty-seven and forty four hundredths (447.44) feet to a point ofcurvature, said point being fifty (50) feet southeasterly of, and oppositestation 211+47.44 on said highway plat;

   Thence curving to the right along the arc of a curve having aradius of 140.00 or central angle of 91d-28'-35", and an arc length of 223.52to a point of tangency, said point being fifty (50) feet southwesterly of andopposite station 305+82.38 as shown on State Highway Plat #365;

   Thence running southeasterly along the southwesterly line ofRoute 7 for a distance of four hundred seven and thirty-eight (407.38) feet tothe point and place of beginning, said last course forming an interior angle of50d-30'-45" with the first described course. Said parcel contains 3.96 acres,plus or minus.

   (b) Parcel 2: That certain tract or parcel of land situatedin the town of Smithfield, county of Providence, state of Rhode Island, andbounded and described as follows:

   Beginning at the southwesterly corner of said parcel at apoint fifty (50) feet northwesterly of, and opposite, station 207+00 as shownon State Highway Plat #361;

   Thence running northwesterly, bounded southeasterly by Route116, for a distance of fifty and no hundredths (50.00) feet to a Rhode Islandhighway bound set one hundred (100) feet northwesterly of, and opposite station207+00 on said highway plat;

   Thence turning an interior angle of 135d-45'-25" and runningnortheasterly, bounded northwesterly by land now or formerly of J.S.S.L., Inc.,for a distance of six hundred ninety-four and forty-six hundredths (694.46)feet to a point fifty (50) feet southwesterly of, and opposite station 314+100as shown on State Highway Plat #365;

   Thence running southeasterly along the southwesterly line ofRoute 7 for a distance of one hundred twenty-seven and eighty-five hundredths(127.85) feet to a point of tangency, said point being fifty (50) feetsouthwesterly of, and opposite station 312+71.74 as shown on said highway plat;

   Thence curving to the right, following the southwesterly lineof Route 7, along the curve of an arc having a radius of 1951.94, a centralangle of 10d-23'-59", and an arc length of 354.30, to a point of compoundedcurvature;

   Thence still curving to the right along the arc of a curvehaving a radius of 70.00, a central angle of 95d-10'-08" and an arc length of116.27' to a point of curvature, said point being fifty (50) feet northwesterlyof, and opposite station 212+12.80 as shown on State Highway Plat #361;

   Thence running southwesterly, bounded southeasterly by Route116, for a distance of five hundred twelve and eighty hundredths (512.80) feetto the point and place of beginning, said last course forming an interior angleof 90d-00'-00" with the first described course.

   Said parcel contains 4.09 acres more or less.

   (c) Parcel 3: That certain tract or parcel of land situatedin the town of Smithfield, county of Providence, state of Rhode Island andbounded and described as follows:

   Beginning at the southeast corner of said parcel at a pointfifty (50) feet northwesterly of, and opposite, station 216+00 as shown onState Highway Plat #361;

   Thence running southwesterly, bounded southeasterly by Route116, for a distance of one hundred eighteen and nineteen hundredths (118.19)feet to an angle;

   Thence turning an interior angle of 146d-52'-53" and runningnorthwesterly, for a distance of one hundred twenty and fifty nine-hundredths(120.59) feet to an angle;

   Thence turning an interior angle of 132d-23'-40" andcontinuing northwesterly for a distance of one hundred thirteen and nohundredths (113.00) feet to a point, said point being forty-one (41) feetnortheasterly of, and opposite station 310+00 as shown on State Highway Plat#365, said last two courses bounded southwesterly on Route 7;

   Thence turning an interior angle of 88d-30'-56" and runningnortheasterly, bounded northwesterly by Route 7, for a distance of nine and nohundredths (9.00) feet to a point, said point being fifty (50) feetnortheasterly of, and opposite station 310+00 on said highway plat;

   Thence turning an interior angle of 142d-49'-49" and runningsoutheasterly, bounded northeasterly by land now or formerly of the town ofSmithfield, for a distance of two hundred sixty-two and twenty-one hundredths(262.21) feet to a point, said point being one hundred (100) feet northwesterlyof and opposite station 216+00 on Plat #361;

   Thence turning an interior angle of 119d-22'-42" and runningsoutheasterly, bounded northeasterly by Route 116, for a distance of fifty andno hundredths (50.00) feet to the point and place of beginning, said lastcourse forming an interior angle of 90d-00'-00" with the first described course.

   Said parcel contains 22,164 square feet, more or less.

   (d) Parcel 4: Wherever the words "center line" are used inthe following description, unless otherwise designated, they refer to thecenter line of the Smithfield-Lincoln-Cumberland George Washington Highway 1931survey by the State Board of Public Roads along its various routes andmodifications thereof as shown on Plat #458 and as described below: Thatcertain land located in the town of Smithfield as shown upon the accompanyingPlat #458 together with all rights appurtenant to said land in and to thehighway upon which said land abuts, said land being located along the variousroutes of George Washington Highway so-called, and which lies between thecenter line and a line described as follows:

   Beginning at a point, said point being opposite and onehundred (100) feet southerly from said center line at Sta. 167+48+/- and alsosaid point being in the southerly highway line of George Washington Highwayso-called, as established by Plat #361 by the Rhode Island State Board ofPublic Roads and filed with the Town Clerk of Smithfield, December 2, 1931, atits intersection with a stone wall running in a southerly direction; thencesoutherly along the aforedescribed stone wall to its intersection with thenortherly side of Woonasquatucket River so-called, at a point opposite and fourhundred sixty-six more or less (466+/-) feet southerly from said center line atSta. 164+21+/-; thence southerly along range of the aforedescribed stone wallto a point in the middle of the aforesaid Woonasquatucket River so-called, saidpoint being opposite and five hundred twenty-eight more or less (528+/-) feetsoutherly from said center line at Sta. 163+80-; thence westerly along themiddle of the aforesaid Woonasquatacket River so-called, to its intersectionwith the southerly highway line of George Washington Highway so-called, asestablished by the aforesaid Plat #361 by the Rhode Island State Board ofPublic Roads at a point opposite and one hundred (100) feet southerly from saidcenter line at Sta. 158+00+/- and as shown upon the accompanying Plat #458 bythe Rhode Island State Board of Public Roads.

   (e) Parcel 5: That certain lot or parcel of land situatealong the northerly side of George Washington Highway so-called, in the town ofSmithfield and designed as Parcel #1 on the accompanying Plat #463 by the RhodeIsland State Board of Public Roads together with all rights appurtenant to saidland in and to the highway upon which said land abuts, said land being furtherdescribed as follows:

   Beginning at a point, said point being opposite and onehundred (100) feet northerly from Sta. 167+24+/- of the traverse line of asurvey by the Rhode Island State Board of Public Records entitled"Smithfield-Lincoln-Cumberland, George Washington Highway, 1931 Survey" andalso said point being in the northerly highway line of George WashingtonHighway so-called, as established by Plat #361 by the Rhode Island State Boardof Public Roads and filed with the Town Clerk of Smithfield, December 2, 1931,at its intersection with a stone wall running in a northerly direction; thencenortherly along the aforesaid stone wall for a distance of two hundred fiftymore or less (250+/-) feet to its intersection with a stone wall running in aneasterly direction; thence northerly making an interior angle of 143d-35'-50"with the first mentioned stone wall, for a distance of one hundred fifty-nineand sixty-one one-hundredths (159.61) feet to a point; thence westerly makingan interior angle of 126d-30'-50" with the aforedescribed line for a distanceof three hundred forty-nine and forty-three one-hundredths (349.43) feet to apoint; thence westerly making an exterior angle of 156d-15'-20" with theaforedescribed line for a distance of two hundred seventy-nine more or less(279+/-) feet to its intersection with a stone wall running in anortherly-southerly direction; thence southerly along the aforedescribed stonewall for a distance of seven hundred fifty-nine more or less (759+/-) feet toits intersection with a stone wall running in a westerly direction; thencewesterly along the aforedescribed stone wall and continuing in the range of theaforedescribed stone wall for a distance of one hundred fifty-two more or less(152+/-) feet to the center of the Woonasquatucket River so-called; thencesoutherly along the center of the Woonasquatucket River so-called, to itsintersection with the northerly highway line of George Washington Highwayso-called, as established by the aforesaid Plat #361 by the Rhode Island StateBoard of Public Roads at a point opposite and one hundred (100) feet northerlyfrom Sta. 157+94+/- of the aforsaid traverse line highway line of GeorgeWashington Highway so-called, to the point or place of beginning and as shownupon the accompanying Plat #463 by the Rhode Island State Board of Public Roads.

   Thence running southwesterly, bounded southeasterly by Route116, for a distance of one hundred eighteen and nineteen hundredths (118.19)feet to an angle;

   Thence turning an interior angle of 146d-52'-53" and runningnorthwesterly, for a distance of one hundred twenty and fifty nine-hundredths(120.59) feet to an angle;

   Thence turning an interior angle of 132d-23'-40" andcontinuing northwesterly for a distance of one hundred thirteen and nohundredths (113.00) feet to a point, said point being forty-one (41) feetnortheasterly of, and opposite station 310+00 as shown on State Highway Plat#365, said last two courses bounded southwesterly on Route 7;

   Thence turning an interior angle of 88d-30'-56" and runningnortheasterly, bounded northwesterly by Route 7, for a distance of nine and nohundredths (9.00) feet to a point, said point being fifty (50) feetnortheasterly of, and opposite station 310+00 on said highway plat;

   Thence turning an interior angle of 142d-49'-49" and runningsoutheasterly, bounded northeasterly by land now or formerly of the town ofSmithfield, for a distance of two hundred sixty-two and twenty-one hundredths(262.21) feet to a point, said point being one hundred (100) feet northwesterlyof and opposite station 216+00 on Plat #361;

   Thence turning an interior angle of 119d-22'-42" and runningsoutheasterly, bounded northeasterly by Route 116, for a distance of fifty andno hundredths (50.00) feet to the point and place of beginning, said lastcourse forming an interior angle of 90d-00'-00" with the first described course.

   Said parcel contains 22,164 square feet, more or less.

   (d) Parcel 4: Wherever the words "center line" are used inthe following description, unless otherwise designated, they refer to thecenter line of the Smithfield-Lincoln-Cumberland George Washington Highway 1931survey by the State Board of Public Roads along its various routes andmodifications thereof as shown on Plat #458 and as described below: Thatcertain land located in the town of Smithfield as shown upon the accompanyingPlat #458 together with all rights appurtenant to said land in and to thehighway upon which said land abuts, said land being located along the variousroutes of George Washington Highway so-called, and which lies between thecenter line and a line described as follows:

   Beginning at a point, said point being opposite and onehundred (100) feet southerly from said center line at Sta. 167+48+/- and alsosaid point being in the southerly highway line of George Washington Highwayso-called, as established by Plat #361 by the Rhode Island State Board ofPublic Roads and filed with the Town Clerk of Smithfield, December 2, 1931, atits intersection with a stone wall running in a southerly direction; thencesoutherly along the aforedescribed stone wall to its intersection with thenortherly side of Woonasquatucket River so-called, at a point opposite and fourhundred sixty-six more or less (466+/-) feet southerly from said center line atSta. 164+21+/-; thence southerly along range of the aforedescribed stone wallto a point in the middle of the aforesaid Woonasquatucket River so-called, saidpoint being opposite and five hundred twenty-eight more or less (528+/-) feetsoutherly from said center line at Sta. 163+80-; thence westerly along themiddle of the aforesaid Woonasquatacket River so-called, to its intersectionwith the southerly highway line of George Washington Highway so-called, asestablished by the aforesaid Plat #361 by the Rhode Island State Board ofPublic Roads at a point opposite and one hundred (100) feet southerly from saidcenter line at Sta. 158+00+/- and as shown upon the accompanying Plat #458 bythe Rhode Island State Board of Public Roads.

   (e) Parcel 5: That certain lot or parcel of land situatealong the northerly side of George Washington Highway so-called, in the town ofSmithfield and designed as Parcel #1 on the accompanying Plat #463 by the RhodeIsland State Board of Public Roads together with all rights appurtenant to saidland in and to the highway upon which said land abuts, said land being furtherdescribed as follows:

   Beginning at a point, said point being opposite and onehundred (100) feet northerly from Sta. 167+24+/- of the traverse line of asurvey by the Rhode Island State Board of Public Records entitled"Smithfield-Lincoln-Cumberland, George Washington Highway, 1931 Survey" andalso said point being in the northerly highway line of George WashingtonHighway so-called, as established by Plat #361 by the Rhode Island State Boardof Public Roads and filed with the Town Clerk of Smithfield, December 2, 1931,at its intersection with a stone wall running in a northerly direction; thencenortherly along the aforesaid stone wall for a distance of two hundred fiftymore or less (250+/-) feet to its intersection with a stone wall running in aneasterly direction; thence northerly making an interior angle of 143d-35'-50"with the first mentioned stone wall, for a distance of one hundred fifty-nineand sixty-one one-hundredths (159.61) feet to a point; thence westerly makingan interior angle of 126d-30'-50" with the aforedescribed line for a distanceof three hundred forty-nine and forty-three one-hundredths (349.43) feet to apoint; thence westerly making an exterior angle of 156d-15'-20" with theaforedescribed line for a distance of two hundred seventy-nine more or less(279+/-) feet to its intersection with a stone wall running in anortherly-southerly direction; thence southerly along the aforedescribed stonewall for a distance of seven hundred fifty-nine more or less (759+/-) feet toits intersection with a stone wall running in a westerly direction; thencewesterly along the aforedescribed stone wall and continuing in the range of theaforedescribed stone wall for a distance of one hundred fifty-two more or less(152+/-) feet to the center of the Woonasquatucket River so-called; thencesoutherly along the center of the Woonasquatucket River so-called, to itsintersection with the northerly highway line of George Washington Highwayso-called, as established by the aforesaid Plat #361 by the Rhode Island StateBoard of Public Roads at a point opposite and one hundred (100) feet northerlyfrom Sta. 157+94+/- of the aforsaid traverse line highway line of GeorgeWashington Highway so-called, to the point or place of beginning and as shownupon the accompanying Plat #463 by the Rhode Island State Board of Public Roads.
